Your credit card information will remain on file but will be kept strictly confidential at all times.

Billing Procedures

Account statements are sent via email on the last working day of each month; they include all services provided that month. If you would like to pay your balance by check, it must be received no later than the 10th of the following month. If your payment is not received by the 10th of the following month, we will automatically charge the credit card on file, per our Customer Service Agreement.

For all collection services, including mechanics' liens, stop notices, bond claims etc. we will charge your credit card in advance of performing these services.

CONSUMER NOTICE

Please note Easy Law Construction Notices is not a law firm. We cannot (1) represent you in court, (2) advise you about your legal rights or the law, or (3) select legal forms for you.

CUSTOMER SERVICE AGREEMENT

This Customer Service Agreement (hereinafter "Agreement") contains the terms and conditions for the preparation, mailing, and/or recording of Pre-Lien Notices, Mechanics Liens, Stop Payment Notices, Payment Bond Claims, Miller Act Notices, other related construction notices, and collection services between Easy Law Construction Notices, A Division of Easy Law, Inc., (hereinafter "Easy Law" or “We”) and its Customers. Please read the below information carefully and note that Customers must accept the terms and conditions set forth below before Easy Law will open an account and provide services.

Services and Pricing:

1. The prices which apply to Easy Law’s services are listed on its website here and are subject to change without notice.

Request for Services:

2. Unless Express Service is requested, a minimum of (5) working days is required to complete service requests.

Express Services:

3. A minimum of (2) working days is required to complete express service requests.

Pre-Lien Notices:

4. Requests for Pre-Lien Notices require:

(a) a general description of the work, equipment, or materials you are furnishing;
(b) the name, address, and telephone number of your customer;
(c) the estimated value of your services;
(d) the address or legal description of the construction project;
(e) the date you started working on the project; and
(f) the estimated date for the completion of your work.

Disclaimer:

5. Please note that Easy Law will take reasonable and prudent steps to check and verify the information you submit with your service requests by researching one or more of the available public and private resources including online data bases, and/or by making telephone calls to your clients and others regarding your request. However, since it is not practical to independently verify the accuracy of the information obtained Easy Law does not guarantee its accuracy.

Hold Harmless:

6. Other than for claims stemming from unlawful conduct as defined in Chapter 5 of California Business and Professions Code, Easy Law Customers agree to hold Easy Law, its shareholders, officers, agents, and employees harmless for any and all claims resulting from any loss, damage or injury, of any and every nature, whatsoever, including special or consequential damages, including attorneys' and/or expert's fees by, resulting from, or in any way connected with the performance of any service offered by Easy Law and/or the use of Easy Law's Website and/or the content thereon.

Jurisdiction and Venue:

7. Any legal action against Easy Law by its Customers must be filed in Ventura Superior Court in Ventura County, in the State of California to be decided in accordance with California State law. By accepting this Agreement, the Customer hereby consents to the exclusive jurisdiction of and venue within the State of California for all disputes arising out of or relating to the use of this Website, Content, Information, and/or Easy Law Inc.'s services.

Easy Law is not a law firm:

8. Please note that Easy Law provides its services with the understanding that it is not rendering legal, accounting, or other professional services. For such assistance, the services of a competent licensed professional should be sought.

Attorney-in-Fact:

9. Customer designates Easy Law as its attorney-in-fact thereby giving Easy Law’s employees a limited power of attorney to sign Customer’s Pre-Lien Notices, Mechanics Liens, Stop Payment Notices, Bond Claims, Miller Act Notices, Releases, other related notices and correspondence on Customer’s behalf.

Document Retention:

10. Easy Law retains completed Pre-Lien Notices and proofs of mailing for 2 years from the date its Customers’ request for services are received. Thereafter, Pre-Lien records are destroyed without notice to Customer. Customers may make a written request for the transfer of their original records to another location within 12 months of submitting a request for service; please note however that each transfer request requires the pre-payment of $45.00 plus applicable postage or delivery expense.

Partial Invalidity:

11. If any of the terms and conditions of this Agreement are determined to be invalid or unenforceable in whole or in part pursuant to applicable California law, then the invalid or unenforceable provisions or portion thereof will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the terms and conditions shall continue in effect.

Entire Agreement:

12. This document embodies the entire agreement between the Customer and Easy Law and any subsequent modifications must be accepted in a writing signed by an authorized agent for Easy Law.

Late Payment Fees:

13. Except for pre-paid services where payment is required in advance, Customer agrees to pay for requested services at the rates posted on Easy Law’s website and in accordance with the terms listed on Easy Law’s monthly statement. Invoice amounts are due upon receipt of Easy Law’s monthly statement. A service charge of 1 1/2 % per month on balances outstanding after 30 days (with a minimum charge of $5) will be assessed against all past due accounts.

Duplicate Requests for Services:

14. Please note that Easy Law processes a very large volume of Pre-Lien Notices throughout the United States and is not always able to catch unintended duplicate requests for services. As such, requests that are submitted more than once may be treated as separate requests and go through normal processing and billing. Additionally, please note that Easy Law cannot place service requests on hold; any such requests will be treated as a request to cancel and will be subject to a cancellation charge as listed on the website.

Notice Required by California Business and Professions Code:

15. In accordance with §6410 of the California Business and Professions Code please note that Easy Law is not a law firm and may not perform the legal services that a law firm performs. Although Easy Law is registered and bonded as a Legal Document Assistant in Ventura County, California, the county clerk has not evaluated or approved Easy Law’s knowledge or experience, or the quality of its services. You may obtain information regarding free or low-cost representation through a local bar association or legal aid foundation and you may contact local law enforcement, a district attorney, or a legal aid foundation if you believe you have been a victim of fraud, the unauthorized practice of laws, or any other injury. Easy Law is not permitted to engage in the practice of law, including providing any kind of advice, explanation, opinion, or recommendation to a consumer about possible legal rights, remedies, defenses, options, selection of forms, or strategies.
